AI Drawing Terms

These terms and conditions apply to cases where AI-based functions and tools, including the AI Drawing, are used within MiriCanvas, and this shall be in addition to the application of the Dobby Canvas Terms of Use and the License Agreement. These terms and conditions may be modified by the Company at any time.

Article 1: Purpose
Various AI technology-based functions are in widespread use in various industrial fields and, in particular, have the potential to be utilized as content creation tools by various individuals, such as content creators and artists.
Such potential of AI technology can deliver large-scale benefits in social terms but, at the same time, there are concerns that it may exceed its technological limits or ethical considerations, etc. and be misused.
The Company is endeavoring to create a trustworthy environment so that the Users of Dobby Canvas may turn their creative ideas into designs that are legally and ethically safe and use the same.
Therefore, the Company has prescribed its ethical and technological policy for the provision of AI-based products within Dobby Canvas, and the use of their output, as follows.

Article 2: Definition of Terms
• AI Drawing: the AI-based functions and tools offered by the Company
• Text: the text, etc. entered by the User into the AI Drawing in order to create the AI Output
• AI Output: the content of any Text entered into the AI Drawing function and any image created on the basis of such content
• Technology Partner : the partner company/individual that provides the underlying technology for the AI Drawing, etc. and (or) the related license

Article 3: Restrictions on Use
The Users of Dobby Canvas who use the AI-based functions offered by the Company, including the AI Drawing, shall be deemed to have agreed that they will not use the output created through the AI functions for any of the purposes specified out below.
1. The User shall not, in the process of using the output derived from the use of the AI Drawing function, breach any of the various laws, including the Copyright Act and the Trademark Act, nor infringe on personal information, portrait rights, publicity rights, etc.
2. The User shall not be use the AI-based functions for the purpose of exploiting minors, etc.
3. The User shall not be use the AI-based functions to produce content that contains false information in order to harm another person (for the purpose of infringing on another person’s rights).
4. The User shall not be use the AI-based functions for the purpose of damaging another person’s reputation or to insult or slander another person.
5. The User shall not be use the AI-based functions for the purpose of affecting an individual’s legal rights in an adverse manner or to impose a legally binding obligation.
6. The User shall not be use the AI-based functions on/offline in a way that can discriminate against, or harm, the characteristics or behavior patterns of an individual or group.
7. The User shall not be use the AI-based functions for a purpose that can, by exploiting the vulnerability of an individual or group resulting from their age, or social, physical, or mental characteristics, etc., inflict physical or mental harm on that other person or group.
8. The User shall not be use the AI-based functions for the purpose of discriminating against a characteristic of an individual or group that is protected by law.
9. The User shall not be use the AI-based functions for the purpose of presenting medical advice or offering an interpretation of a medical outcome.
10. The User shall not be use the AI-based functions for the purpose of producing an image, document, etc. which is such that an individual who uses it as a form of document with a legal effect can commit a crime.
11. The User shall not be use the AI-based functions in the creation of spam, ransomware, keylogger, virus, or other software.
12. The User shall not be use the AI-based functions to create obscene or lascivious content.

Article 4: Liability and Obligations
1. The Company shall not be liable for any legal disputes that have arisen as a result of the use, by the User, of the AI Output for a purpose specified in Article 3 of these terms and conditions.
2. In using the content of the Text entered into the AI Drawing function and any image created on the basis of such content (hereinafter, “AI Output”), the User shall be obliged to check and comply with the relevant policies, etc., including the Company’s terms and conditions on the AI Drawing function, and shall be fully liable in respect of any de facto or legal liability that arises in the event of non-compliance. It shall be the User’s responsibility to check whether he or she is compliant with the Company’s policy on the use of AI Output.
3. The User agrees that he or she will not enter personal information, including race, country of origin, ethnic group, political views, religious or philosophical beliefs, membership of trade unions, health data, or data about sex life or sexual orientation, within any Text that is entered when using the AI Drawing function.
4. The User shall have copyright and ownership of any Text that has been entered and the AI Output and shall grant the Company the authority to use the same to market and improve its services. Vesting of rights to the AI Output may be changed as a result of enactment/amendment of the relevant laws, etc.
5. The Company shall not assert copyright or ownership over any Text that has been entered by the User or the AI Output that has been obtained by the User through the AI Drawing.
6. If the User agrees to these terms and conditions and agrees that he or she has full responsibility for the use of the AI Output, the AI Output may be used freely subject to the restrictions under Article 3.
7. If an assertion is made that the Text entered by the User or the AI Output obtained by the User through the AI Drawing is either illegal or in breach of these terms and conditions, the Company may disclose the relevant content to the law enforcement agency or other government agencies.

Article 5: Sharing and Posting
Posting by the User of the Text entered into the AI Drawing and the AI Output on the social media shall satisfy the following conditions.
• The User shall review the AI Output that is about to be shared or streamed, or has been posted, to check whether it breaches these terms and conditions.
• Content containing the AI Output shall be marked with the User’s name, or the name of the company, etc. with which the User is affiliated, to indicate its source.
• It shall be marked clearly so that users who see the shared material or post can see that the relevant content is output that has been created by AI.
• No post or content containing the AI Output shall breach these terms and conditions or offend another person.
• AI Output that has been created through the AI Drawing shall not be presented as if it has been created completely independently by the User.

Article 6: Exemption from Liability
AI Output has been created by artificial intelligence, and the Company does not guarantee the accuracy or representative nature of the AI Output.
• The Company provides no assurance or guarantee whatsoever regarding the accuracy, completeness, or credibility of the AI Output.
• The Company shall have no liability whatsoever for any dispute or harm that arises as a result of the User’s use of the AI Output.
• The Company shall not be liable for any omission or error included in the AI Output.
• If an assertion of rights infringement is made by a third party against the User as a result of the AI Output produced by the User using the AI Drawing, the User shall indemnify the Company at his or her cost and responsibility.
In order to create a credible content, careful consideration should be given before placing reliance on the accuracy of the AI Output.

Article 7: Technology Partner
In order to offer the AI-based functions, including the AI Drawing, the Company uses the technology model provided by a third party service provider, and the Company is subject to the Creative ML OpenRAIL-M license.
